A prenuptial agreement often called a “prenup”is no longer reserved for the ultra-wealthy or celebrity couples. In Kenya today, more couples are choosing to enter marriage with clarity, transparency, and mutual protec tion by signing a formal prenuptial agreement.

What Is a Prenuptial Agreement?

In Kenya, the right to enter a prenup is expressly provided under Section 6(3) of the Matrimonial Property Act, 2013, which states:

A prenup may define:

This is especially relevant where foreign spouses cannot appear on Kenyan land titles.

A well-drafted prenup defines what happens when a “Termination Event” occurs. This may include:

  • Filing for divorce or separation

  • A written notice expressing intention to separate

  • Annulment of marriage

Upon termination, the prenup guides:

  • How assets are divided

  • Whether spousal support is paid

  • What happens to jointly owned property

  • The handling of trust interests, companies, or foreign assets

The clarity reduces conflict and protects both parties.

Will A Kenyan Court Uphold a Prenuptial Agreement?

Yes, Kenyan courts regularly enforce prenups as long as they meet legal requirements. Courts will examine:

  • Whether there was undue influence

  • Whether the financial disclosure was honest and full

  • Whether each party had legal advice

  • Whether the terms are fair

A properly drafted prenup from the outset is the best way to secure enforceability.

Do Prenuptial Agreements Address Child Custody or Child Support?

No. Any clause that tries to predetermine child custody or child support is invalid because children’s rights cannot be negotiated or waived by parents.

Only a court can determine what is in the best interest of the child.
